Information we process on behalf of our clients

Linkers provides support services to business clients. When we handle calls, messages, scheduling, or records for a client, we process personal information about that client’s customers, patients, students, or leads. In those cases we act as a service provider on the client’s instructions. That information is governed by the client’s own privacy policy, and we use it only to deliver the services the client has engaged us for.

2. How We Use Your Information

We use personal information to:

  • Respond to your inquiries, consultation requests, and trial requests.
  • Set up, deliver, and manage the services you have engaged us for.

  • Send text messages where you have opted in, as described in Section 3.
  • Process job applications and communicate with candidates.
  • Operate, maintain, secure, and improve the Website and our services.
  • Comply with legal obligations and enforce our Terms and Conditions.

We do not use your personal information for automated decision-making that has legal or similarly significant effects on you.

How we collect SMS consent

We only send text messages to people who have given us their express consent. You give consent by ticking the separate, unchecked SMS consent box on our Website contact form, or by replying to a text message from us asking you to confirm that you wish to receive messages. Consent to receive text messages is not a condition of purchasing any goods or services from us. You can submit our contact form and use our services without agreeing to receive text messages.

What we do with your mobile information

We use your mobile phone number and SMS consent record only to send the messages described above, to keep a record of your consent and any opt-out requests, and to meet carrier and legal requirements. We do not sell or rent your mobile phone number or SMS opt-in data. We do not share your mobile information or SMS consent with third parties or affiliates for their marketing or promotional purposes. Your mobile information may be shared with the aggregators, carriers, and messaging platform providers that are needed to deliver the text messages to you.

4. How We Share Information

We share personal information only in the following circumstances:

  • Service providers: with vendors that help us operate our business, such as web hosting, email delivery, customer relationship management (CRM) systems, scheduling tools, telephony and messaging platforms, analytics, and IT support. These providers may only use your information to perform services for us.
  • Our clients: if you contact us on behalf of a business that is a Linkers client, or if we are handling communications for a client, relevant information is shared with that client as part of delivering the service.
  • Legal and safety: when required by law, subpoena, or court order, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud or security issues.
  • Business transfers: if Linkers is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to this Privacy Policy.
  • With your consent: for any other purpose you have agreed to.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

We do not sell personal information, and we have not sold personal information in the preceding 12 months.

5. Data Retention

We keep personal information for as long as needed to fulfil the purposes described in this Privacy Policy, to deliver our services, to comply with legal, accounting, or reporting obligations, and to resolve disputes. SMS consent records and opt-out requests are kept for as long as required by carrier and legal requirements so that we can demonstrate that consent was given and honoured. Job applicant information is kept for a reasonable period after the hiring decision in case a suitable role becomes available, unless you ask us to delete it sooner.

6. Your Privacy Rights

Depending on where you live, you may have the following rights regarding your personal information:

  • Access: to request a copy of the personal information we hold about you.
  • Correction: to ask us to correct inaccurate or incomplete information.
  • Deletion: to ask us to delete your personal information, subject to legal exceptions.
  • Portability: to receive your information in a portable format.
  • Opt out of marketing: to stop receiving marketing emails by using the unsubscribe link in any email, and to stop text messages by replying STOP.
  • Non-discrimination: we will not treat you differently for exercising your privacy rights.

Residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and other states with consumer privacy laws may have additional rights under those laws, including the right to know what categories of personal information we collect and the purposes for which we use them, as described in this Privacy Policy.

To exercise any of these rights, email us at info@linkersbpo.com with the subject line “Privacy Request”. We may need to verify your identity before responding. We will respond within the time required by applicable law. You may also authorise an agent to make a request on your behalf.

If you are a customer, patient, student, or lead of one of our clients and want to exercise your rights over information we process on that client’s behalf, please contact the client directly. We will support our clients in responding to your request.
