Terms & Conditions

Effective date: October 1, 2026 | Last updated: October 1, 2026

These Terms and Conditions (“Terms”) govern your use of the website linkersbpo.com (the “Website”) and the services offered by Linkers BPO LLC (“Linkers”, “we”, “us”, or “our”). By accessing the Website, submitting a form, booking a consultation, starting a trial, or using our services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or our services.

1. About Our Services

Linkers provides business process outsourcing and customer experience services to businesses, including inbound call handling, outbound calling, appointment scheduling, live chat and messaging support, and related administrative support. Our services are offered to businesses, not to individual consumers. The specific scope, hours, and terms of any engagement are set out in a separate written proposal, service agreement, or order confirmed between Linkers and the client. If there is a conflict between these Terms and a signed service agreement, the signed service agreement applies to that engagement.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our services. If you are using the Website or our services on behalf of a company or organisation, you confirm that you have the authority to bind that organisation to these Terms.

3. Pricing, Trial, and Payment

  • Our standard rate is $13.99 per hour per agent, billed only for active agent hours worked. There are no setup or onboarding fees.
  • New clients may start with a 2-month (60-day) trial. The trial is a fully operational service and is billed at the standard hourly rate. At the end of the trial we provide a performance review, after which the client may continue under an ongoing agreement or end the engagement with no further obligation.
  • Invoices are issued monthly for the previous month’s hours unless a different schedule is agreed in writing. Payment terms, accepted payment methods, and any late payment charges are stated on the invoice or in the service agreement.
  • Hours are tracked and reported to the client. Any dispute about billed hours must be raised in writing within 14 days of the invoice date.
  • Custom or tailored plans may be quoted separately, and the terms of those quotes apply to those plans.

4. Client Responsibilities

To allow us to deliver the services, the client agrees to:

  • Provide accurate, complete, and timely information, access to required systems and tools, and any training materials needed for the engagement.
  • Hold all rights, licences, and consents needed for Linkers to access the client’s systems and to contact the client’s customers, patients, students, or leads on the client’s behalf.
  • Comply with all laws that apply to the client’s business and to the communications we carry out for the client, including telemarketing, consumer protection, privacy, and healthcare privacy laws where relevant.
  • Not ask Linkers to carry out any communication or activity that is unlawful, misleading, abusive, or in breach of a third party’s rights.

5. SMS and Text Messaging Terms

Program name: Linkers SMS Notifications

Service description: By opting in, you agree to receive text messages from Linkers at the mobile number you provided. Messages relate to your inquiry or account with us and may include consultation and appointment confirmations and reminders, scheduling updates, replies to questions you have sent us, service and onboarding updates, and account or billing notifications.

How to opt in: You opt in by ticking the separate, unchecked SMS consent box on our Website contact form, or by replying to a text message from us asking you to confirm that you wish to receive messages. Consent is not a condition of purchase. You can use the Website and our services without opting in to text messages.

Message frequency: Message frequency varies. You may receive up to 4 messages per week depending on your interactions with us.

Message and data rates: Message and data rates may apply. Check with your mobile carrier for details of your plan.

How to opt out: You can cancel at any time. Reply STOP to any message you receive from us to unsubscribe. After you send STOP, we will send one final message to confirm that you have been unsubscribed. You will then receive no further messages from this program. If you want to join again, reply START to a message from us or sign up again through our Website.

Help and support: Reply HELP to any message for assistance, call us at +1 (570) 609-2693, or email us at info@linkersbpo.com.

Carriers: Carriers are not liable for delayed or undelivered messages. Delivery of messages depends on your carrier and network coverage.

Privacy: Your mobile information and SMS consent are handled as described in our Privacy Policy. We do not share your mobile information or SMS opt-in data with third parties or affiliates for their marketing or promotional purposes.

If you change or deactivate your mobile number, you agree to update us or opt out so that messages are not sent to a number that no longer belongs to you. You are responsible for any charges from your carrier for messages you receive.

6. Acceptable Use of the Website

You agree not to:

  • Use the Website for any unlawful purpose or in breach of these Terms.
  • Submit false, misleading, or fraudulent information through any form on the Website.
  • Attempt to gain unauthorised access to the Website, its servers, or any connected systems.
  • Introduce viruses, malware, or any harmful code, or interfere with the normal operation of the Website.
  • Scrape, copy, or republish Website content without our written permission.

7. Intellectual Property

The Website and its content, including text, graphics, logos, and design, are owned by Linkers or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your own business use in evaluating our services. Any other use requires our written permission. Materials, data, and systems that a client provides to us remain the property of the client. Any processes, templates, and know-how that Linkers develops in the general course of delivering services remain the property of Linkers.

8. Confidentiality

Each party agrees to keep the other party’s confidential information private and to use it only for the purpose of the engagement. This includes business information, customer and contact data, pricing, and internal processes. This obligation continues after the engagement ends. It does not apply to information that is publicly available, already known to the receiving party, or required to be disclosed by law.

9. Data Protection

Where Linkers processes personal information on behalf of a client, Linkers acts as a service provider and processes that information only on the client’s documented instructions and for the purpose of delivering the services. The client is responsible for having a lawful basis to collect and share that information with us. Where a client operates in a regulated sector, such as healthcare, the client and Linkers will agree any additional data protection terms required by law, such as a Business Associate Agreement, before protected information is shared.

10. Service Standards and Changes

We will deliver the services with reasonable care and skill, using agents trained for the client’s sector and workflows. Agents are supervised while live, and reporting is provided to the client as agreed in the engagement. We may replace or reassign agents when needed to maintain service quality. We may update our service offerings, pricing for new engagements, and these Terms from time to time. Changes to pricing do not affect an engagement already agreed in writing unless the client agrees to the change.

11. Termination

Either party may end a trial at any time by written notice. After the trial, the notice period and termination terms are set out in the ongoing service agreement. Either party may end an engagement immediately by written notice if the other party commits a serious breach of these Terms or the service agreement and does not fix it within 14 days of being notified. On termination, the client must pay for all hours worked up to the termination date, and each party will return or delete the other party’s confidential information on request.

12. Disclaimer of Warranties

The Website is provided “as is” and “as available”. We do not guarantee that the Website will be uninterrupted, error-free, or free of viruses. Except as expressly stated in these Terms or a signed service agreement, we make no warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Any performance figures shown on the Website are examples of past results and are not a guarantee of future results for any client.

13. Limitation of Liability

To the fullest extent permitted by law, Linkers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to the Website or the services, even if we have been advised of the possibility of such damages. Our total liability to a client for any claim arising out of an engagement will not exceed the total fees paid by that client to Linkers in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

14. Indemnification

The client agrees to indemnify and hold Linkers and its officers, members, employees, and agents harmless from any claims, losses, damages, and expenses, including reasonable legal fees, arising from the client’s breach of these Terms, the client’s instructions to us, the client’s failure to obtain required consents, or the client’s violation of any law or third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute arising out of these Terms or the Website will first be addressed through good-faith discussion between the parties. If the dispute is not resolved within 30 days, it will be brought in the state or federal courts located in Wyoming, and both parties consent to the jurisdiction of those courts. Nothing in this section prevents either party from seeking urgent injunctive relief in any court of competent jurisdiction.

16. General

  • Entire agreement: These Terms, the Privacy Policy, and any signed service agreement form the entire agreement between you and Linkers regarding the Website and the services.
  • Severability: If any part of these Terms is found to be unenforceable, the rest of the Terms will remain in effect.
  • No waiver: Our failure to enforce any right under these Terms is not a waiver of that right.
  • Assignment: You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
  • Notices: Notices to Linkers must be sent by email to info@linkersbpo.com or by mail to the address below.
